Markscheider - apply for recognition

You would like to carry out activities in Baden-Württemberg that are reserved for mine surveyors according to the Federal Mining Act or other legal regulations? To do so, you need recognition as a mine surveyor. If you have a corresponding foreign professional qualification, you must have it checked whether it meets the requirements for recognition.

Details

Prerequisite

Prerequisites for the recognition are:

  • You possess the qualification for the higher civil service in the Markscheide subject.
  • You have the qualifications required for the work of a mine surveyor
    • Reliability and
    • physical and mental fitness.
  • You are younger than 70 years of age.

Notice You do not have the required reliability, for example, if you

  • are incapacitated or
  • have a court order restricting your ability to dispose of your assets.

You are physically or mentally unsuitable for example, if you are permanently incapacitated to carry out a professional surveying activity due to a physical infirmity or mental weakness.

Have you passed an examination as a mine surveyor outside the Federal Republic of Germany? Then recognition can be granted if the training and examination correspond to the type and scope of training and examination for the higher civil service in the Federal Republic of Germany and if the Ministry of the Environment confirms this. The assessment of equivalence is made within the framework of the decision on recognition as a mine surveyor. Please enclose the documents listed below for the assessment of equivalence with the application for recognition.

If the training and examination are not equivalent, for recognition as a mine surveyor additional training and the passing of a supplementary examination may be required.

Procedure

You must apply for recognition as a Markscheider in writing to the office responsible for recognition. You must sign it by hand or provide it with a qualified electronic signature. The procedure can be handled by a single point of contact within the meaning of the Act on Single Points of Contact for the State of Baden-Württemberg.

For applicants with a foreign professional qualification, the Ministry of the Environment must confirm the equivalence of your professional qualification. The assessment of equivalence is carried out as part of the decision on recognition as a mine surveyor. Please enclose the required documents with your application for recognition. You will receive an acknowledgement of receipt within one month.

Upon application, you can also receive a separate decision from the Ministry of the Environment on the determination of equivalence.

You will receive a certificate of recognition. The competent body will enter you in a publicly accessible register. This contains the names and addresses of the branches and addresses of the offices of the recognised examiners.

Required documents

The application must be accompanied by

  • curriculum vitae
  • proof of the required qualification for the higher civil service in the field of mine surveying
    • if you have passed an examination as a mine surveyor outside the Federal Republic of Germany: equivalence of the corresponding training outside Germany; the assessment is made by the Ministry of the Environment within the procedure
  • medical certificate
    • for applicants from other EU Member States or another contracting state of the Agreement on the European Economic Area (EEA):
      • a medical certificate required in that state or
      • a certificate of physical and mental health issued by the competent authority
  • declaration that you have applied to the registration office for a certificate of good conduct for submission to the competent authority
    • if you reside abroad: documents from your home country proving your personal reliability
  • declaration of existing or intended place of establishment with all branch and satellite offices

Note: Under certain circumstances, the competent authority may waive the requirement to submit certain documents. Please enquire about this with the competent office.

 

Additionally, for applicants with a foreign professional qualification, to confirm the equivalence of your professional qualification:

The following documents are required for the assessment of equivalence:

  1. a tabular list in German of the training courses you have completed and the gainful employment you have had
  2. proof of identity
  3. evidence of training acquired abroad
  4. evidence of relevant professional experience and other evidence of qualifications, insofar as these are required to establish equivalence
  5. if available, a certificate of entitlement to exercise the profession in the country of training
  6. a statement as to whether an application for authorisation to take up or pursue a regulated profession has already been submitted and, if so, to which body, as well as a decision issued

Note: Documents 2 to 6 must be submitted in the form of copies or electronically. Translations in German of documents 3 to 5 must be submitted. In addition, translations in German of the documents according to 2 and all subsequently submitted documents may be required. The translations shall be prepared by a publicly appointed or sworn interpreter or translator.

In addition, further required information may be requested if necessary.

Processing time

Maximum 3 months after receipt of the complete documents

Miscellaneous

As a legal remedy, you can file an administrative court action against the decision or also in the case of an excessively long processing time (action for failure to act).
